ABSTRACT

The European Union’s Artificial Intelligence Act (AI Act), adopted in 2024, represents a landmark regulatory framework for AI systems, with profound implications for healthcare. This paper examines the challenges and opportunities posed by the AI Act in the context of an increasingly volatile geopolitical landscape, marked by rising military expenditures, trade tensions, and global supply chain disruptions. As healthcare becomes more reliant on AI—from diagnostic tools to robotic surgery—the Act’s classification of medical AI as “high-risk” introduces stringent requirements for transparency, data governance, and human oversight. While these measures aim to safeguard patient safety, they risk stifling innovation, particularly for smaller healthcare providers and startups lacking resources to navigate complex compliance demands. Geopolitical instability further complicates this balance. Europe’s rearmament amid the Ukraine conflict diverts funding from healthcare innovation, while recent U.S. tariffs on semiconductors disrupt supply chains for AI-driven medical devices. Retaliatory EU tariffs on U.S. goods, including pharmaceuticals, threaten to inflate costs for already strained healthcare systems. Meanwhile, the U.S.-China AI race pressures Europe to reconcile ethical regulation with technological sovereignty, as restrictive policies may drive talent and investment elsewhere. The paper argues that the AI Act’s success hinges on mitigating unintended consequences. For instance, AI diagnostic tools—classified as high-risk—could improve care in underserved regions but face barriers due to regulatory burdens. Similarly, dual-use AI technologies (e.g., military applications) blur ethical lines, demanding nuanced governance beyond the Act’s current scope. To address these challenges, we propose six actionable steps: (1) Multidisciplinary task forces to streamline regulations via “regulatory sandboxes”; (2) AI literacy programs for clinicians to bridge the gap between innovation and practice; (3) Resilient supply chains through diversified sourcing and EU-based semiconductor production; (4) International collaboration to harmonize standards and share AI solutions globally; (5) Human-augmented AI systems, where clinicians verify AI outputs to ensure reliability; and (6) Ethical guidelines for high-stakes scenarios (e.g., triage during conflicts), prioritizing equity and accountability. The intersection of AI regulation, healthcare, and geopolitics demands urgent attention. Without proactive measures, Europe risks lagging in the global AI race while failing to harness AI’s potential for equitable healthcare. This paper calls on policymakers, clinicians, and technologists to forge a path where innovation thrives within ethical guardrails—even in an era of uncertainty.
